Between the minimal insurance requirements and the number of drivers without insurance, Florida is often considered one of the worst places in the US to have a car accident.
As shocking as it sounds, the facts are 1 in 3 FL drivers has ZERO coverage for damage/pain/injuries they cause to another person in an auto accident. Look around as you do go through your day, at a stoplight, in line to pick up your child at school or parking at the mall. Every third vehicle could leave you no recourse to recover money for medical bills, time missed from work or pain and suffering if you were injured in an accident they caused.
Studies show about 25% of FL drivers are not insured and another 7%-10% who do have insurance are underinsured, often significantly.
While we will pursue action against their assets, if the at-fault driver doesn’t have adequate insurance, the only guaranteed way to protect yourself is to maintain your own comprehensive policy. Ideally, your personal policy will contain Bodily Injury and Uninsured Motorist coverage. Depending on your location, driving record, age & deductible this can be included for as little as $15/month
In cases where the at-fault driver is uninsured or underinsured and there are no assets to file a claim against, there is no source of money to cover expenses. In this situation, we receive no payment for our time and our hard work. Even more difficult to accept is knowing our injured clients without their own robust personal auto policy are often left responsible for bills, missed work & deprived of financial compensation for their pain and suffering.
So while the other guy can be deemed responsible for the accident and resulting injuries, if there is little or no insurance and no assets, the other guy doesn’t end up paying and the injured victim can be left with a stack of bills and few options.
