Wauchula, FL (September 16, 2018) - A pregnant woman was killed while walking along the roadway on Monday, September 10th. According to Florida Highway Patrol, 25 year old Josefina Pablo Aguire was walking on Old Bradenton Road around 6:45 am when she was struck by a vehicle driven by 31 year old Jose Manuel Montes-Loredo.
Pablo Aguire died on Thursday, September 13th from her injuries. Her unborn child also died as a result of the crash. At the time, Pablo Aguire was walking with her 8 year old daughter and 6 year old son. The 8 year old was not hurt, however, the 6 year old did suffer unspecified injuries.
Montes-Loredo was charged with careless driving invovling death and driving without a license following an investigation.
Troopers say 31-year-old Jose Manuel Montes-Loredo was driving north on Old Bradenton Road in Wauchula near Falcon Lane at 6:45am Monday morning when he went off the road onto the grass shoulder. His vehicle struck 26-year-old Josefina Pablo Aguirre and her 8-year-old daughter and 6-year-old son.
At the time, Pablo Aguirre, who was 8-months pregnant, was walking down the road with her children as they biked near her. Pablo Aguirre's unborn child was killed and Pablo Aguirre was left in a coma. She died Thursday from her injuries. Her 8-year-old daughter was unhurt, but her 6-year-old son suffered serious injuries.
Manuel Montes-Loredo has been charged with careless driving involving a death and was arrested for driving without a valid license involving a death.
In 2017, Florida ranked second overall among all states for the most pedestrian fatalities. Over 500 people die each year across our state in pedestrian related accidents.
In this crash, it appears as though the driver is at fault for the death of Josefina Pablo Aguire, her unborn child and her 6 year old son. Along with the criminal charges he is facing, he will also face civil liability for his negligence. The family of Josefina Pablo Aguire may consider bringing a wrongful death claim on her behalf. A claim for injuries suffered by the 6 year old son may also be brought on his behalf. This is certainly a tragic situation for all involved.
