Jose* was a construction worker. He was married and had three young children. One day, at work, while walking along the outer walkway on the 13th floor of a high-rise project, he fell through a plywood bridge and fell to his death. Through our investigation and work we proved that the company responsible for maintaining the walkway failed to insure that the appropriate safety devices were in place to support the plywood bridge. We were able to show that Jose fell through what amounted to a concealed trapdoor. We overcame defense arguments of lack of notice, comparative negligence, negligence of a non-party defendant (Fabre), lack of liability, and workers’ compensation immunity. The recovery for the family totaled $3.9 million. The court-appointed guardian ad litem in the case wrote in his report, “I feel the settlement is an excellent one and the attorneys for the estate should be commended for achieving such an outstanding result.” *Names have been changed to protect the privacy of our client.
Highway 113, FL – Highway 113 Crash Takes Life of One Individual
On Wednesday night, one person lost their life in a Highway 113 Crash just north of Flomaton. The two-vehicle accident took the life of a man from Illinois.
Safety Harbor, FL - Lucas Scholing Killed in Motorcycle Crash on 49th Street South
A 79-year-old motorcyclist from Safety Harbor died in a crash involving another vehicle on Saturday, January 18th. The crash took place around 5:30 a.m. on 49th Street North.
Reports indicate that Lucas M. Scholing was riding a Honda motorcycle in the southbound lanes of 49th. As Scholing attempted to turn left onto State Road 688, he was struck by a Volkswagen Jetta. The driver of the Jetta, 57-year-old Kathryn Lynne Jackson, failed to stop at a red light and caused the crash to occur. Scholing was transported to a local hospital where he later succumbed to his injuries. There is no report of any other injuries in the crash.
