Jordan Kirby - Premises Liability

Final Result: $650,000

Uber driver drops off a passenger inside of a boatyard and is found floating in the water the next morning. No witnesses and no video of what occurred. While the body of the Uber driver was found the next morning, the vehicle wasn't found for another 21 days - under water in the travel lift slip at the boatyard. Through accident reconstruction analysis, we claimed that the decedent backed into the travel lift slip as he was attempting to maneuver his way out of a tight space. With a light out just above the travel lift slip and no other barricade or warning that open water was just feet away from the driving aisle, the decedent unknowingly drove into the water. The 36 year old decedent was survived by his mother with whom he lived, and his father who lived in Peru.
